Terms of Use – ClarityOS

Controller: Aurion Dynamics, a sole proprietorship owned and operated by Jeroen Kopczinski (“Aurion Dynamics”, “we”, “our”, “us”)

Product: ClarityOS – web-based diagnostic application

1. Acceptance of Terms

By creating an account or using ClarityOS (“Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Service. These Terms apply to all users, whether acting as individuals or on behalf of an organization.

2. Eligibility

You must be at least 18 years old (or the age of majority in your country) to use ClarityOS. If you use ClarityOS on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. The Service

ClarityOS is a web-based platform that helps organizations diagnose and manage clarity through structured input, AI analysis, and decision intelligence features. We continually improve and may update or change the Service at any time, with or without notice.

4. Account and Workspace Management

  • Accounts are created through our authentication provider (Clerk).
  • You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
  • Workspaces are user- or organization-managed containers of data (strategic intents, signals, problems, decisions).
  • You remain solely responsible for the accuracy, legality, and appropriateness of data entered into your workspace(s).

5. User Data and Ownership

You retain ownership of all content you enter into ClarityOS (signals, problems, strategic intents, etc.). By using the Service, you grant us a limited license to process that data solely to provide and improve the Service. We do not claim ownership of your data.

6. Intellectual Property

All rights, title, and interest in ClarityOS, including its design, code, and content (excluding user-provided data), remain the exclusive property of Aurion Dynamics. You may not copy, distribute, reverse engineer, or otherwise exploit ClarityOS except as permitted by these Terms or with our written permission.

7. Payments

  • If you subscribe to ClarityOS, payments are processed securely by Stripe.
  • Pricing and billing terms are displayed at the time of subscription.
  • Subscriptions automatically renew unless cancelled prior to the renewal date.

8. No Professional Advice

ClarityOS provides AI-powered recommendations and analyses. You acknowledge and agree that:

  • The Service is for informational purposes only.
  • The Service does not constitute legal, financial, medical, or professional advice.
  • You remain solely responsible for all decisions and actions taken based on recommendations or outputs generated by ClarityOS.

We expressly disclaim all liability arising from reliance on the Service for decision-making.

9. Prohibited Use

You may not use ClarityOS to:

  • Violate laws or regulations.
  • Upload unlawful, harmful, or sensitive personal data (such as health or political information).
  • Interfere with or disrupt the Service.
  • Attempt to reverse engineer or gain unauthorized access.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms, misuse the Service, or we reasonably believe termination is necessary to protect the Service or other users. You may stop using ClarityOS at any time. Data deletion is governed by our Privacy Policy.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

  • We do not guarantee that the Service will be uninterrupted, secure, or error-free.
  • We do not guarantee that outputs generated by AI will be accurate, reliable, or suitable for your specific use case.

12. Limitation of Liability

To the maximum extent permitted by law: Aurion Dynamics shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or €100 if you used the Service for free).

13. Indemnification

You agree to indemnify and hold harmless Aurion Dynamics and its owner against all claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the Service or by email. Continued use of the Service after changes take effect constitutes your acceptance.
